[전 좌석 안전띠 단속 안내문 / 출처 : 경찰청 블로그 ‘폴인러브’ 경남지방경찰청 제작]
지난 2018년 3월 27일 개정, 공포되어 2018년 9월 28일부터 시행된 도로교통법의 개정 내용에 따라 시내주행에서도 ‘전 좌석 안전띠 착용’이 의무화 되었습니다.
이에 따라 경찰은 12월1일부터 31일까지 한 달간 전 좌석 안전띠 착용 의무 위반 대한 특별단속을 실시하고 있습니다.
이미 알려진 바와 같이 좌석안전띠 미착용시 아래와 같은 처벌이 따릅니다.
도로교통법상 좌석안전띠 미착용 시 처벌
– 운전자 본인 미착용(법 제50조제3항 위반) 시 : 범칙금 3만원
– 동승자 미착용(법 제50조제1항․제2항, 제67조제1항 위반) 시 : 과태료 3만원
/동승자 13세 미만인 경우 6만원
단속대상은 자가용 뿐만 아니라 택시, 대중교통, 통근버스 등도 포함됩니다.
단속함에 있어 여러 가지 경우의 수가 많기 때문에 경찰의 단속 어려움 뿐만 아니라 단속 대상이 반발하는 경우도 발생하는 것으로 전해집니다.
경찰의 입장에서는 썬팅 등으로 인하여 운행 중인 차량 실내를 육안으로 다 볼 수 없어 단속에 어려움을 겪기도 하며, 택시 같은 경우 승객에게 기사가 고지를 하였는지 여부를 판단하기 어렵다고 전해지고 있습니다. (동승자 미착용시 과태료가 3만원이나 택시 등의 경우 운전자가 안전벨트를 매도록 안내를 하였음에도 불구하고 매지 않았어야 합니다.)
한편, 대리운전이나 기사가 따로 있는 자동차의 경우 일반 승용차와 같은 운전자로 볼 것인지 택시기사와 같은 경우로 볼 것인지 아직 명확하게 판단을 내려진 것이 없는 경우도 있기 때문에 운전의 형태를 증명해야 하는 몇몇 케이스를 풀어야 할 숙제로 남겨두고 있습니다.
이제 운전자 및 승객 자신의 생명과 신체의 안전을 위해 전 좌석 안전띠를 착용하도록 의무화 된 만큼 자신의 생명을 지킨다는 생각으로 어떤 차량이든 탑승하면 안전띠를 매는 것을 습관화 하는 것이 바람직합니다.
자동차에 앉는 위치가 생명을 보장해 주지 않습니다.
어느 자리든 최소한 안전띠를 매고 있어야 사고나 긴급상황 발생시 안전을 담보 할 수 있습니다.
